An error in diagnosis or a failure to diagnose is when a physician has enough information to make the appropriate diagnosis, but for whatever reason does not recognize significant diagnostic studies or clinical presentations where they can put together a diagnosis. And because of that delay, a patient may suffer some real harm. That’s what a failure to diagnose case is.
